Justice Department appoints Jack Smith as special prosecutor overseeing Trump crimes

Charles Dharapak/AP Attorney General Merrick Garland on Friday appointed former Justice Department Public Integrity Officer Jack Smith to oversee the Justice Department’s criminal investigation into former President Donald Trump. Smith oversees the department’s investigation into possible mishandling of classified documents and presidential records on Trump’s Mar-A-Lago estate, as well as key aspects of the department’s January 2nd. 6 investigation. He said, “Given the recent circumstances, such as the fact that the former president announced that he would run for the next presidential election and the incumbent president also expressed his intention to run, we concluded that appointing a special appointment is in the public interest.” Garland said at a press conference. “These appointments underscore the department’s commitment to independence and accountability, particularly on sensitive matters. It also allows prosecutors and deputies to continue their work expeditiously and make decisions based solely on the facts and the law.” Garland’s decision comes three days after Trump announced he would run again for the White House and claimed Republicans won a majority in the House in the next Congress. “I firmly believe that the normal procedures of this department can handle any investigation honestly. I also believe that the appointment of a special counsel at this time is the right thing to do,” Garland said. “The special circumstances presented here call for it. Mr. Smith is the right choice to complete this matter in a fair and urgent manner.” Smith most recently served as Chief Prosecutor of the Hague Special Court investigating and adjudicating war crimes in Kosovo. He moved to the International Criminal Court (ICC) in 2008, oversaw all war crimes investigations conducted by the Prosecutor’s Office, and in 2010 took charge of the Public Integrity Office of the Ministry of Justice. Smith said in his statement he issued after he was publicly nominated. “The speed of the investigation will not stop or wane under my watch. I will exercise independent judgment and pursue the investigation swiftly and thoroughly, whatever the outcome the facts and law dictate.”
